BINASURA ng Korte Suprema ang petisyon ng Senado na ipasawalang bisa ang naging memorandum ni Dating Pangulong Rodrigo Roa Duterte noong 2021 na nag-uutos sa mga executive branch officials na huwag daluhan ang Senate inquiries na may kinalaman sa pandemic deals ng gobyerno.
Matatandaan na nagkaroon ng pagdinig ang Senate Blue Ribbon Committee noong 2021 sa naging budget utilization ng gobyerno kasunod ng Commission on Audit (COA) report na umabot sa P67-B ang deficiency sa COVID-19 funds.
Ang mga opisyal ng gobyerno hindi na sumipot sa pagdinig kasunod ng memorandum ng Pangulo sa pamamagitan ni Executive Secretary Salvador Medialdea noong Oktubre 4, 2021.
Punto ng kautusan ni Dating Pangulong Duterte, ang naging inquiry ng SBRC ay nagmistulang preliminary investigation na pinangungunahan na ang mandato ng ibang sangay ng gobyerno.
Kasunod naman nito, ay pagpasa ng Senate ng resolusyon para sa paghahain ng petisyon sa korte.
Pero saad naman ng Korte Suprema, hindi nila nakikitang kailangan resolbahin ng korte ang petition for certiorari ng Senate Blue Ribbon Committee.
Punto ng SC, mayroong jurisdictional power ang Senado na hindi saklaw o puwedeng saklawin ng Korte Suprema.
“To maintain the separation of powers between the three departments of the government, the Court cannot exercise a power that belongs to the Senate Blue Ribbon Committee (SBRC),” pahayag ng Korte Suprema.
Ayon dito, ang Senate inquiry ay nasa jurisdiction ng Joint Congressional Oversight Committee sa ilalim ng Bayanihan Law.
Mayroon umano mga miyembro ang oversight committee kung saan ang mga isyu ay maaring ayusin o remedyuhan sa ilalim ng kanilang Rules of Procedure.
Isa umano sa prerequisite sa paghahain ng petition for centiorari ay kung walang mabilis at sapat remedyo para sa isyu.
Sa bahagi umano ng SBRC, mayroon itong paraan para resolbahin ang naging naturang memorandum.
“The Court, however, found that the Senate’s petition failed to meet the third requisite as the SBRC itself has a remedy within its office to resolve the jurisdictional challenge raised by the President in the Memorandum.”
“Under Section 3 of the Senate Rules of Procedure Governing Inquiries in Aid of Legislation (Senate Rules), if the jurisdiction of the Committee is challenged on any ground, the said issue must first be resolved by the Committee before proceeding with any inquiry,” ayon sa Korte Suprema.
