PINAL nang pinagtibay ng Korte Suprema ang constitutionality ng Anti-Terror Law.
Sa nangyaring En Banc deliberation sa Baguio City ng mga mahistrado ng Supreme Court, binasura ang inihaing motions for reconsideration ng mga petitioner.
Ayon sa Supreme Court En Banc, ang nasabing desisyon ay naisagawa dahil anila kulang ng substantial issues at argumento ang inilahad ng petitioners.
“The Court resolved to deny the motions for reconsideration due to lack of substantial issues and arguments raised by the petitioners,” saad ng Korte Suprema ng bansa.
December 7, 2021 nang unang magpalabas ng desisyon ang Kataas-taasang Hukuman na nagbabasura sa mga petisyon ng ilang mga mambabatas, militanteng grupo at ilang non-government organizations.
Isinulat ito ni retired Justice at ngayo’y Philippine Judicial Academy Chancellor Rosmari Carandang.
“The Members of the Court maintained their vote in their December 7, 2021 Decision, which was penned by then-Associate Justice and now Philippine Judicial Academy Chancellor Rosmari D. Carandang. Newly appointed Associate Justice Antonio T. Kho Jr. sided with the majority,” nakasaad sa Korte Suprema.
Samantala, ikinalugod naman ng Palasyo ang pagbasura ng Korte Suprema sa mosyon laban sa Anti-Terror Law.
Ayon kay acting Presidential Spokesperson Sec. Martin Andanar itinuturing nilang tagumpay para sa mga Pilipino ang naturang hakbang ng korte at isa rin itong babala laban sa mga masasamang elemento sa bansa.
“We welcome the latest decision of the Supreme Court on Republic Act 11479, otherwise known as the Anti-Terrorism Act of 2020. We consider this latest high court ruling a triumph for all peace-loving and law-abiding Filipinos as it serves as a stern warning against malevolent elements that the Philippines is not a safe haven for terrorists,” pahayag ni Andanar.
