NAIS isulong ni Atty. Israelito Torreon sa confirmation of charges hearing ang kawalang ng hurisdiksiyon ng International Criminal Court (ICC) sa Pilipinas.
Kasunod ito ng naganap na pre-trial chamber hearing ng ICC sa umano’y paglaban ni dating Pangulong Rodrigo Roa Duterte sa crimes against humanity.
Ani, Torreon sa isasagawang confirmation of charges hearing na itinakda sa Setyembre 23, 2025.
“I would also i-attack na mismo ang jurisdiction because under Article 127 paragraph 2 of the Rome Statute, dapat sana wala na talagang jurisdiction dito ang ICC kasi nawala na tayo sa jurisdiction nila effectively March 17 of 2019. Tapos preliminary examination na ginawa ng ICC noong 2018 hindi po ‘yun counted. Kasi ang counted dapat is may judicial determination talaga para maski na wala na tayo sa ICC kung mayroong judicial determination that can be considered as matter under consideration then pwede pa mag-exercise ‘yung jurisdiction ‘yung ICC pero dito kasi nagawa,” pahayag ni Atty. Israelito Torreon, Legal Counsel.
Sinabi pa ni Torreon na ‘yung pre-trial chamber ay 2021 na nag-issue ng court order para sa pormal na imbestigasyon sa “War on Drugs” kung kaya’t malinaw na wala na itong hurisdiksiyon sa Pilipinas dahil late na ito ginawa.
Maliban sa kawalan ng hurisdiksiyon ng ICC, nais din maipunto ni Atty. Torreon sa ICC ang ginawang pag-aresto sa dating Pangulo na aniya’y hindi makatao.
“The way Pres. Rodrigo Duterte treated, inhuman. Dire-diretso lang dinakip,” ani Torreon.
“Under article 59 kasi dapat dinulog siya sa nearest competent judicial authority, para ma-determine sana kung siya ba talaga ‘yung nasa warrant kung ang proseso na-follow ba at saka kung narespeto ba ‘yung rights niya. Dito kasi hindi na-follow iyan which is a clear violation of his right,” aniya pa.
Una na ngang iginiit ni dating Executive Secretary Salvador Medialdea sa pre-trial chamber hearing na ang pagpapadala kay dating Pangulong Duterte sa ICC ay isang uri ng extrajudicial rendition.
“Your honors, the whole world has witnessed the degrading fashion in which a former president of a sovereign country was bundled onto a private aircraft and summarily transported to The Hague. To us lawyers this would be called an extrajudicial rendition-to the less legally inclined it was pure and simple kidnapping. My client was denied all access to legal recourse in the country of his citizenship and this-all in the name of political score settling,” pahayag ni Atty. Salvador Medialdea, Legal Counsel, FPRRD.
Samantala, sinabi ni Torreon na susubukan ng legal team ng dating Pangulong Duterte ang lahat ng legal redemy upang maibalik agad sa Pilipinas.
