KOJC, iginiit na overkill ang raid ng PNP-SAF at CIDG sa KOJC religious compounds

NANINDIGAN ang legal counsel ng the Kingdom of Jesus Christ na si Atty. Israelito Torreon na overkill ang sana’y pagsisilbi lamang ng arrest warrant laban kay Pastor Apollo C. Quiboloy at lima pang kasamahan nito.

Ito’y matapos na namataan ang naka-full battle gear na mga operatiba ng PNP Special Action Force at CIDG na animo’y makikipag giyera dahil sa mga bitbit na matataas na kalibre ng armas.

Nakita rin sa bisinidad ng KOJC ang pag-iikot ng dalawang police helicopters.

Paliwanag ni Atty. Torreon, hindi naman kailangan mag-deploy ng ganoon kalaking puwersa kung magsisilbi lamang ng arrest warrant dahil maaari naman itong idaan sa maayos at mahinahon na paraan.

“Overkill in the sense that I have already cited in Rule 113 Section 2 that there shall be no violence or unnecessary force. Si Pastor Apollo Quiboloy naman is a religious person, the members of Jesus Christ or co-accused with him are likewise not known to be violent persons. So, therefore the force that should have been exerted of there was a need to exert the same should be proportionate. This is the doctrine of proportionality, whether they apply in the international law or merely criminal law you would not really find any justification in the shear of force. Bukod sa nakakalulang bilang ng mga armadong awtoridad, nilabag din ng mga pulis ang pag-akyat ng mga ito sa gate ng KOJC nang walang pahintulot at dokumento kaugnay sa kanilang pakay sa loob ng compound.

“By any yard stick that you would apply, you can reduce an reasonable conclusion that force was therefore unreasonable and the shear number of was likewise excessive and therefore a violation of the very rules of engagement of the Philippine National Police,” dagdag ni Torreon.

Matatandaang sentro ng kontrobersiya ngayon ang kapulisan dahil sa marahas na paglusob nito sa ilang religious compounds ng Kingdom na walang search warrants.

Samantala, patung-patong na kaso naman ang maaaring isampa ng the Kingdom of Jesus Christ laban sa mga miyembro ng PNP-SAF at CIDG dahil sa raid nito sa mga compounds ng KOJC nitong Lunes Hunyo 10, 2024.

Pinag-aaralan na ito ngayon ng legal counsel ng KOJC dahil sa mga nangyaring ilegal na paglusob sa mga compound nito.

“The possible cases that can be filed in case the Kingdom authorities would decide to do so would first the art 269 (unlawful arrest) this can file against public officers or even private individuals who conducts arrest or detention if he is not authorized by law or whether is no reasonable ground therefore. That’s 1 possible case. Another case is Art 132 interruption of religious worship because at 3:50 am the members were already conducting a devotional prayers which a manifestation of a religion and this is a ceremony conducted by religious persons therefore, all the elements were present and if the Kingdom authorities would decide this is an option likewise,” dagdag ni Atty. Torreon.

Criminal cases

Art 269 o unlawful arrest (an arrest without reasonable ground therefore)

Art 132 o interruption of a religious worship (members of the KOJC were praying as manifestation of religious ceremony)

Art 124 o arbitrary detention (deprivation of liberty vs 9 KOJC members being detained by the PNP)

Malicious mischief (destruction of the gate)

Child abuse

Habang maaari ding sampahan ng reklamong administratibo ang mga pulis dahil sa mga ipinakita nitong pag-abuso sa kanilang mga kapangyarihan.

Administrative cases:

Grave misconduct

Grave abuse of authority

Conduct of unbecoming a public officer

Kinukonsidera din ang pagsasampa ng kasong child abuse laban sa mga PNP operatives kasunod ng mga naiulat na pagkatrauma ng mga bata sa ilang compounds na niraid ng mga awtoridad partikular na sa Glory Mountain, Brgy Tamayong, Calinan, Davao City.

Ayon sa mga abogado ng Kingdom, hindi basta basta ang naging epekto sa mga bata ngayon dulot ng paglusob ng mga pulis sa KOJC dahil tila nagtanim na ito ng pagkatakot lalo na sa tuwing may kaluskos o naririnig na tunog sa kanilang paligid.

“We are also looking into child abuse considering the trauma that the children in these situations were subject to. As of the present that is all I can say on the matter as well as the act that one of places that was searched for the presence of Pastor Quiboloy in the warrant of arrest was JMC, Jose Maria College. We are also looking into possible violations of the fact that they searched a school,” saad ni Atty. Dinah Tolentino-Fuentes, Legal Counsel, KOJC.

Nauna nang nagsampa ng kasong obstruction of justice ang PNP laban sa 9 umano na humarang sa pagpasok ng mga pulis sa Glory Mountain dahil na rin sa arogante at bayolenteng kilos ng mga ito papasok sa compound ng KOJC sa Brgy. Tamayong Calinan Davao City.

Matapos ang interogasyon, pinalaya rin ang siyam na miyembro ng Kingdom matapos mapag-alaman na nagtratrabaho lamang ang mga misyonaryo sa Glory Mountain.

Samantala, inihayag na rin ni dating Pangulong Rodrigo Roa Duterte, na siyang administrator din ng KOJC properties, na hindi niya palalampasin ang ganitong lantarang paglabag sa batas ng mga awtoridad.
