DUMATING ng 8:37 am ng Biyernes sa Sandiganbayan si Sen. Jinggoy Estrada para sa pagbabasa ng hatol matapos ang 10 taong paglilitis sa kaniyang P183-M plunder case na may kaugnayan sa multi-billion Development Assistance Fund (PDAF) Projects scam na nabunyag noong 2013.
Naging mabilis ang promulgation at nakakuha ito ng paborableng desisyon matapos ipawalang-sala ng 5th Division ng Sandiganbayan si Estrada sa kasong plunder.
Ang akusasyon, nakakuha ang senador ng P183-M na kickback dahil sa pag-eendorso ng bogus na non-government organization (NGO) kay Janet Lim Napoles para sa kaniyang Priority PDAF Projects.
Una nang itinanggi ni Estrada ang mga akusasyon.
Sa desisyon ng korte, sinabi nitong walang criminal intent ang pagpopondo ni Estrada sa mga NGOs ni Napoles dahil parte ito ng kaniyang trabaho bilang public official na nabigyan ng PDAF allocations.
“Estrada’s acts, from requesting the release of his PDAF allocations to the execution of letters of endorsement and memoranda of agreement, are all related to the exercise of his functions as a public official. Being a senator who is allocated with PDAF, he exercised full control over the release thereof and had the sole discretion as to the livelihood project that would be funded by it. His endorsements of Napoles’ NGOs to implement projects funded by his PDAF could not have materialized if not for the public office he held,” ayon sa 5th Division Sandiganbayan.
Wala rin aniyang sapat na ebidensiya na nakinabang si Estrada sa mga NGO ni Napoles.
Kung lusot sa plunder si Estrada, nahatulang guilty naman ito pagdating sa one count of direct bribery na may parusang 8-9 taon at 4 na buwang pagkakakulong.
Guilty rin siya sa 2 counts of indirect bribery at may parusang 2 taon at 4 na buwan hanggang 3 taon at 6 na buwan na pagkakakulong.
Pinagbabayad siya ng Sandiganbayan ng P3-M bilang multa.
Pinatawan din siya ng temporary disqualification to hold from public office, at diskwalipikasyon sa paglahok sa halalan.
Sinabi naman ni Estrada na gagamitin nila ang lahat ng legal remedy para mabaliktad ang desisyon ng korte pagdating sa panunuhol.
“Nothing is final, that is bailable, we will file necessary motion for reconsideration to the Sandiganbayan”.
“This is a vindication in my name I am victorious at this point but to the conviction of the indirect bribery I am not a lawyer, I have not read the decision but I am so surprised based from the information sheets there is no bribery, direct o indirect bribery filed in the information sheets but only the case of plunder,” ayon kay Sen. Jinggoy Estrada.
“I will ask my lawyers to exhaust all legal remedies or legal options available for me and I still believe,” dagdag ni Estrada.
Janet Lim Napoles, pinawalang sala rin sa plunder ng Sandiganbayan
Samantala, ang kaniyang co-accused na si Napoles, no show sa promulgation.
Kapareha ni Estrada, absuwelto ito sa kasong plunder pero guilty sa 5 counts at two counts ng corruption of public officials.
Sa 5 counts, hinatulan ito ng mahigit 50 taong pagkakakulong habang walong taon naman sa two counts.
Estrada, mananatili pa ring senador sa kabila ng court ruling—Zubiri
Samantala, sinabi naman ni Senate President Migz Zubiri na mananatili pa ring senador si Estrada dahil sa maaari pang mabaliktad ang desisyon ng Sandiganbayan.
Maaari pa aniyang umapela si Estrada sa Sandiganbayan at sa Korte Suprema.
“He has the right to exhaust all of these. He can still file a Motion for Reconsideration with the Sandiganbayan; He can still file an appeal by certiorari with the Supreme Court,” ayon kay Sen. Juan Miguel Zubiri.
“Until and unless the decision becomes final and executory, Sen. Jinggoy is duty-bound to continue performing his functions as Senator of the Republic,” dagdag ni Zubiri.
