HINAMON ng National Task Force to End Local Communist Armed Conflict (NTF-ELCAC) na lumantad sa publiko ang nagpakilalang tagapagsalita ng CPP-NPA na si Marco Valbuena.
Naniniwala ang task force na bogus ito at bahagi lang ng propaganda laban sa gobyerno ang mga inilalabas na pahayag.
Kaugnay nito, ayon sa mga nagbalik-loob nang mga rebelde, maraming nagagalak na mga dati nilang kasamahan sa alok ngayon ng Marcos administration na amnestiya para sa kanila tungo sa kanilang pagbabagong buhay.
“To complete this reintegration process I will issue a proclamation granting amnesty to rebel returnees and I ask Congress to support me in this endeavor,” pahayag ni Pangulong Ferdinand R. Marcos, Jr.
Amnestiya para sa mga rebelde
Ito ang binigyang-diin ni Pangulong Ferdinand R. Marcos, Jr. sa kaniyang pangalawang State of the Nation Address (SONA) kamakailan para lubos na makamit ang kapayapaan sa bansa.
Kasabay ng paghimok na ito ng Pangulo sa mga miyembro ng mga communist terrorist group (CTG) ay ang pagsisikap ng pamahalaan na maipaabot sa publiko hanggang sa malalayong lugar ang serbisyo sa gobyerno.
Ito ay sa pamamagitan na rin ng pagpapaigting sa nasimulan nang community development and livelihood programs.
Kung saan naging epektibo sa paglaban sa kaguluhan sa kanayunan, dala ng CPP-NPA-NDF, ang Barangay Development and Enhanced Comprehensive Local Integration Programs.
Ngunit ang magandang alok na ito ni Pangulong Marcos na makatutulong para sa kapayapaan ng bansa ay hindi sinang-ayunan ng Communist Party of the Philippines (CPP).
Kaya naman ang executive director ng National Task Force to End Local Communist Armed Conflict (NTF ELCAC) na si Usec. Ernesto Torres Jr. ay hinamon ang nagpapakilalang tagapagsalita ng CPP-NPA na si Marco Valbuena na lumantad sa publiko.
“Let him come out siguro this is my call on Marco Valbuena for us to seat down and debate of the merits of the amnesty proclamation come out in the open show your face and do not remain faceless spokesperson of the CPP-NPA for all you know there maybe some goes points that you would like to raise but we are not seeing that because you are not exposing yourself to the public,” wika ni Usec. Ernesto Torres Jr., Exec. Dir, NTF-ELCAC.
Sa isang pulong balitaan sa Kampo Aguinaldo, Quezon City, araw ng Martes, binigyang-diin ni Usec. Torres na hindi totoo ang pagkatao ni Marco Valbuena at bahagi lang ang pahayag nito sa mga propaganda laban sa gobyerno.
“To us in the government, I guess if the statement is coming from a faceless individual caring the name of the CPP-NPA we can downplay that as a mere propaganda coming from the handful desperate operators of the CPP-NPA that is how I look at it the condemnation of the amnesty” dagdag ni Torres.
Hindi lahat ng rebeldeng CPP-NPA-NDF, makakakuha ng amnestiya—Presidential Peace Adviser
Samantala, sa kaparehong media briefing ay ipinaliwanag ni Presidential Peace Adviser Sec. Carlito Galvez na hindi lahat ng mga miyembro ng communist terrorist groups na CPP-NPA-NDF ang pasok sa iaalok na amnestiya ng pamahalaan.
Kabilang sa inirekomenda nilang amnestiya ay ang muling pagproklama ng Proclamaton Number 1093 ni dating Pangulong Rodrigo Roa Duterte noong 2021 at masuportahan ito muli ng Kongreso.
Sa ilalim ng section 1 ng Proclamation 1093 ni dating Pangulong Duterte, ilan sa maaaring maging saklaw ng amnestiya ay ang mga may kasong:
* Rebellion or insurrection;
* Conspiracy and proposal to commit rebellion or insurrection;
* Disloyalty of public officers or employees;
* Inciting to rebellion or insurrection;
* Sedition;
* Conspiracy to commit sedition;
* Inciting to sedition;
* Illegal assembly; Illegal association;
* Direct assault;
* Indirect assault:
* Resistance and disobedience to a person in authority or the agents of such person;
* Tumults and other disturbances of public order;
* Unlawful use of means of publication and unlawful utterances;
* Alarms and scandals;
* Illegal possession of firearms, ammunition or explosives, sa kondisyon na ito ay may kaugnayan sa krimen na rebellion or insurrection; and
* At mga kasong may kaugnayan sa mga krimen na nagawa dahil sa kanilang politikal na paniniwala. Pero ito ay kung may maipakitang sapat na ebidensiya na may kaugnayan kanilang political beliefs
Proclamation No. 1093 ni dating Pangulong Rodrigo Roa Duterte
SECTION 1. Grant of Amnesty. – Amnesty is hereby granted to former rebels of the CT who have committed crimes in pursuit of their political beliefs, whether punishable under the Revised Penal Code or special penal laws, including but not limited to the following:
* Rebellion or insurrection;
* Conspiracy and proposal to commit rebellion or insurrection;
* Disloyalty of public officers or employees;
* Inciting to rebellion or insurrection;
* Sedition;
* Conspiracy to commit sedition;
* Inciting to sedition;
* Illegal assembly;Illegal association;
* Direct assault;
* Indirect assault:
* Resistance and disobedience to a person in authority or the agents of such person;
* Tumults and other disturbances of public order;
* Unlawful use of means of publication and unlawful utterances;
* Alarms and scandals;
* Illegal possession of firearms, ammunition or explosives, provided that these crimes or offense were committed in furtherance of, incident to, or in connection with the crimes of rebellion or insurrection; and
* Those charged, detained or convicted of common crimes but who can establish by substantial evidence that they have actually committed said crimes in pursuit of political beliefs;
Ang mga may kasong paglabag sa Republic Act (RA) No. 9372, o mas kilala sa tawag na Human Security Act of 2007, at RA No. 11479 o ang Anti-Terrorism Act of 2020.
“May mga exception tayo na hindi na pwede mako-cover sa amnesty ‘yung tinatawag natin na under sa UN na convention which one ‘yung sa genocide, yung tinatawag natin na terroristic action at also ‘yung tinatawag natin ‘yung crimes against humanity,” pahayag ni Sec. Carlito Galvez, Office of the Presidential Adviser on Peace, Reconciliation.
Kaugnay nito tiniyak ni Usec. Torres na dadaan sa proseso ang usapin ng amnestiya upang maging malinaw ang buong detalye at upang hindi ito maabuso kagaya ng mga naunang amnestiya na binigay ng mga nagdaang administrasyon.
“With all the experiences that we had right now we are fully confident that the framers of the amnesty program would factor in all of this and would come out with the amnesty program that is suited to the changing times which applicable to the current times,” dagdag ni Torres.
Nananawagan ang NTF-ELCAC sa mga tunay na nagmamahal sa bayan na tapusin na ang laban kontra sa mga komunistang teroristang CPP-NPA-NDF sa pamamagitan ng pagsuporta sa mga programa ng pamahalaan kagaya na lang ng pagbibigay ng amnestiya sa mga dating naligaw ng landas.
