MATAPOS amyendahan ng En Banc ang COMELEC Resolution 10728, ay exempted na sa election gun ban ang ilang government senior officials, mga NBI Agents at election officers.
Ito ang siyang naging anunsyo ni COMELEC Chair Saidamen Pangarungan sa isang press conference kahapon.
Ayon kay Pangarungan, hindi nito gusto na manganib ang buhay ng mga opisyal dahil sa kawalan ng kakayahan na madepensahan o maprotektahan ang kanilang sarili dahil sa gun ban.
“I want to emphasize also that these exemptions were enjoyed by qualified senior government officials in previous elections. These officials we believe need to feel secured,” pahayag ni Pangarungan.
Ang mga opisyales na kasama sa bagong exemptions para sa gun ban ay ang bise presidente ng Pilipinas, ang Senate president at mga senador, House speaker at mga kongresista na pinapayagang magkaroon ng dalawang security detail.
Kasama rin sa exemption ang Chief Justice at ang lahat ng Justices sa Supreme Court, mga justices ng Court of Appeals, Sandiganbayan at Court of Tax Appeals.
Sakop din ng exemption ang mga judges o hukom ng mga Regional Trial Courts and Municipal/ Metropolitan/ Circuit Trial Courts.
Maging ang SolGen, Cabinet secretaries, Undersecretaries at Assistant Secretaries ay kasama sa exemption.
Kasama rin ang Ombudsman na may dalawang security detail, kasama ang mga imbestigador at prosecutors sa Ombudsman.
Ganun din ang Prosecutor General, Chief State Prosecutor, State Prosecutors, at mga prosecutors ng National Prosecution Service of the Department of Justice.
Exempted na rin sa election gun ban ang lahat ng organic NBI agents at panghuli ay election officers (EO), Provincial Election Supervisors (PES), at Regional Election Directors (RED).
Nilinaw naman COMELEC Chair na si Pangulong Rodrigo Roa Duterte ay covered na ng nakaraang exemptions.

“You know we granted a certificate of authority to the Armed Forces of the Philippines, lahat ng sundalo mayroon silang authority to carry firearms, in the same manner yung lahat ng police mayroong general authority to carry firearms. Don’t forget that the president is commander in chief of the Armed Forces of the Philippines so mayroon na siyang dating exemption si President Duterte,” ani Pangarungan.
Ayon naman sa COMELEC, may mga kondisyon para sa paggawad ng exemptions.
Una, kung ang mga nabanggit na opisyal ay nagmamay ari ng License to Own and Possess Firearms, Certificate of Firearms Registration, valid Permit to Carry Firearms Outside of Residence.
Pangalawa kung ang mga ito ay nagdadala lamang ng dalawang firearms at ang pangatlo ay dapat bago mag –Abril 9 ay makapagbigay na ito ng listahan ng kanilang mga firearms at qualified security detail.
“This is automatic, effective and executory itong resolution, automatic iyan but they are required to comply with conditions I mentioned,” saad ni Pangarungan.
Ang gun ban ay epektibo mula noong Enero 9 hanggang Hunyo 8 2022.
