MULING nanindigan si Solicitor General Menardo Guevarra na ang gobyerno ay walang legal na obligasyon na makipagtulungan sa mga prosecutor ng International Criminal Court (ICC) sa imbestigasyon ng mga alegasyon ng krimen laban sa giyera kontra droga ng administrasyon ni dating Pangulong Rodrigo Roa Duterte.
Ito ang iginiit ni Guevarra kasabay sa ikalawang pagdinig ng House Committees on Justice at on Human Rights nitong Miyerkules, Nobyembre 29 hinggil sa tatlong resolusyon na humihikayat sa pamahalaan na papasukin ang mga kinatawan ng ICC para magsagawa ng sariling pagsisiyasat sa war on drugs ng nakaraang administrasyon.
Si Guevarra ay naglingkod bilang Kalihim ng Department of Justice (DOJ) noong administrasyon ni FPRRD.
“Kasi hindi naman pepwedeng forever perpetually nakatutok sa atin ang ICC kahit na hindi na po tayo miyembro ng ICC. ‘Yun po ang paliwanag kung bakit there is no legal duty on the part of the Philippine Government to cooperate,” pahayag ni Menardo Guevarra, Solicitor General.

Iginiit ni Guevarra at ng iba pang mga ahensiya ng pamahalaan na may kinalaman sa usapin, na tanging si Pangulong Ferdinand R. Marcos, Jr. lang ang makakapagpasya kung sasang-ayon o hindi ang pamahalaan ng Pilipinas sa imbestigasyon ng ICC.
“I’m sure that if the propose resolutions come to pass and they are adopted as institutional positions of both the House and the Senate, the President will definitely consider your resolutions but whether or not he will actually follow your request that we cooperate is something that he alone as head of the government, head of state and representative of the Republic may decide on,” dagdag ni Guevarra.
“I believe that we have to defer to the orders of our principals and of course at this interest is the President of the Philippines,” ayon kay Hazel Decena-Valdez, OIC Senior Deputy State Prosecutor, Department of Justice.
“We are of the humble view that the PNP will just submit to the position of the President as head of the executive department to which PNP is under, and also with the SILG (Secretary of the Interior and Local Government),” wika ni PBGen. Rodolfo Castil, Deputy Director, PNP Directorate for Investigation & Detective Management.
“Whatever is the decision of the President, the Department of Foreign Affairs will support it,” saad ni Janice Sanchez Rivera, Acting Director, Department of Foreign Affairs.
Sa nasabing pagdinig, tanging ang Commission on Human Rights lang, bilang isang independent body, ang nagbigay ng katiyakan na makikipagtulungan sa ICC kung kinakailangan.
“Your honor, the commission is more than willing to coordinate if the ICC so deems that they need our cooperation,” ayon kay Faydah Dumarpa, Commissioner, Commission on Human Rights.
“We are an independent constitutionally created commission for the promotion and protection of human rights. Therefore, we may and we’ll be happy to cooperate if the ICC deems fit that they need assistance from the CHR,” aniya.
Nauna nang sinabi ni Pangulong Marcos na tapos na ang pakikipag-usap ng pamahalaan sa ICC. Ngunit kamakailan lamang, sinabi ng Pangulo na ang posibleng pagbabalik ng bansa sa ilalim ng ICC ay kasalukuyang inaaral.
Samantala, iginiit naman ni House Committee on Human Rights chair Bienvenido Abante Jr., na walang personalan kundi sa pagtataguyod ng Rule of Law lamang ang kanilang nais ipatupad kasunod ng planong muling pagpasok sa bansa ng ICC.
“Our commitment to the rule of law is the fundamental pillar of our democracy. By cooperating with the (ICC), even after our withdrawal from the Rome Statute, we demonstrate that no one is above the law, and we are accountable for our actions. This resolution is about principles, not personalities. And the rule of law is a sacrosanct principle,” wika ni Cong. Bienvenido Abante Jr., Chairperson, House Committee on Human Rights.

Matapos ang higit apat na oras na deliberasyon ng dalawang pinagsanib na komite, inaprubahan ang House Resolution 1477 na inihain ni Manila 6th District Rep. Bienvenido Abante Jr. at 1-Rider Party-list Rep. Ramon Rodrigo Gutierrez. Ang HR 1482 ni Albay Rep. Edcel Lagman at HR 1393 ni ACT Teachers Party-list Rep. France Castro at Kabataan Party-list Rep. Raoul Manuel, at Gabriela Party-list Rep. Arlene Brosas.
Kasunod ng pag-apruba ng nasabing resolusyon, sumang-ayon ang magkasanib na Komite na makipag-ugnayan sa kanilang mga katuwang sa Senado upang gawing Joint Concurrent Resolution ang panukala.
Inaasahang pagbobotohan ang tatlong resolusyon sa plenaryo ng Kamara sa susunod na linggo.
