INIHAYAG ng Commission on Elections (COMELEC) na maaari pa ring matuloy sa Disyembre ang Barangay at SK Elections (BSKE) kasunod ng petisyon sa Korte Suprema na huwag payagan ang kanselasyon nito.
Personal na tumungo kamakailan sa Korte Suprema ang election lawyer na si Atty. Romy Macalintal para ihain ang petisyon na magpapabasura sa batas para sa pagpapaliban ng BSKE.
Argumento ni Macalintal, walang karapatan ang Kongreso na mag-postpone ng anumang halalan kasama ang BSKE.
Sa eksklusibong panayam naman ng programa ng SMNI na Business and Politics kay COMELEC Chair Atty. George Garcia, sinabi nito na inaasahan na nila na magkakaroon ng oposisyon ang batas.
“As I correctly predicted I said, somebody will definitely question the legality and constitutionality of this law. It can either be a citizen’s arm, an interest group, a private individual, or a taxpayer, and well a taxpayer actually filed a case yesterday in the Supreme Court,” pahayag ni Garcia.
Agad namang inatasan ng Korte Suprema ang COMELEC na magkomento kung saan naka-schedule na rin bukas ang oral argument para dito.
Sabi ng COMELEC, welcome sa kanila ang anumang petisyon hinggil sa BSKE postponement.
Ayon kay Garcia, dahil sa inakyat na sa SC ang petisyon, maaari pang magkaroon ng pagbabago at matuloy sa Disyembre ang halalan.
“It can either be the Supreme Court will immediately dismiss the petition or the Supreme Court will take cognizance of the case meaning that the case will be given due course and therefore require the COMELEC as the party respondent to comment on the new law or even the Office of the Solicitor General to comment on the petition or the Supreme Court may either grant the request for a temporary restraining order or status quo ante order in which case if that will happen then the status quo, is maintain and therefore the December 5, 2022 elections will push through, that’s why the COMELEC is in a dire predicament at this point. That is why we are awaiting so much the announcement or the news that will be coming from the Supreme Court,” ayon kay Garcia.
Sinabi naman ng COMELEC na sakaling magkakaroon ng TRO para sa pagpapaliban ng BSKE, medyo nasa alanganin ang poll body kung pag-uusapan ang pag-iimprenta ng mga balota.
Ito ay dahil inihinto na ng COMELEC ang pag-iimprenta nito kasunod ng pagpasa ng batas dahil kailangan din na baguhin ang petsa sa mga balota.
Nasa 91M ang kailangang maimprenta ng COMELEC sakaling matutuloy pa ang BSKE sa Disyembre.
“We suspended the printing in order for us to change the date to meet the proper adjustments. It’s not easy to change the date because we have to prepare a new template. We are to print 91-M ballots, 67 million ballots for the regular voters and almost 22-25 million ballots for the SK,” ani Garcia.
Ang sunod na problema pa rito ay ang mga gagamiting ballot boxes.
“The second scenario will be, do we have the ballot boxes in place because as far as were concerned last 2 weeks or three weeks ago, we are lacking more than 20,000 ballot boxes to be used for the Barangay and SK elections,” ayon kay Garcia.
Sa kabila nito sinabi ng COMELEC na anuman ang ilalabas na desisyon ng Korte Suprema ay walang magagawa ang COMELEC dito.
Sakali aniyang magkakaroon ng status quo, at kailangang ituloy ang halalan, walang magagawa ang komisyon kundi ang sumunod.
“We are in a dire predicament but of course, that’s our mandate that’s in the constitution. We have to comply. Therefore, if that is the case in the present law, we’ll be at this point if there is a status quo ante order, a TRO from the Supreme Court is that we have to proceed by December 5, 2022,” dagdag ng opisyal.
