BINASURA ng Korte Suprema ang tatlong consolidated petitions na kumukwestiyon sa mga inilabas na regulasyon ng IATF sa COVID-19 pandemic.
Dahil sa nalabag ang hierarchy of courts, kaya dinismiss o ibinasura ng Korte Suprema ang mga petisyon na kumukwestiyon sa constitutionality o legalidad ng mga regulasyon ng Inter-Agency Task Force for the Management of Emerging Infectious Diseases (IATF), ng mga local government unit at mga ahensiya ng gobyerno pagdating sa COVID-19 pandemic.
“The Supreme Court En Banc, during its session on Tuesday, July 11, 2023, dismissed the petitions challenging the constitutionality of the numerous regulations issued by the Inter-Agency Task Force for the Management of Emerging Infectious Diseases in the Philippines (IATF) in relation to the COVID-19 pandemic, as well as those issued by local government units and government agencies,” pahayag ng Korte Suprema.
Matatandaan na nagpalabas ng iba’t ibang resolusyon ang IATF kasama na ang Guidelines on Nationwide Implementation of Alert Level System for COVID-19 Response noong Pebrero 27, 2022.
May iba-ibang resolusyon ding inilabas para sa COVID-19 ang MMDA, LTFRB, DILG, DepEd, DOH, at Makati City.
Nakasaad sa isang IATF resolution na ang mga eligible employees ng lahat ng pampubliko at pribadong establisimyento na magtra-trabaho on the site ay dapat obligahin na magbakuna kontra COVID-19, o sumailalim sa RT-PCT testing kada 2-linggo at ang gastos dito ay sagot ng empleyado at iba pa.
Ayon naman sa mga petitioners, ang naturang polisiya ay pagyurak sa kanilang kalayaan at karapatan sa buhay.
Paglabag din umano ito sa karapatan nilang makabiyahe.
Discriminatory din anila ang polisiya laban sa mga hindi bakunado sa COVID-19.
Pero giit ng Korte Suprema, ang mga argumento ng mga petitioner ay nangangailangan ng isang fullblown proceeding mula sa mababang korte.
Ang paghahain ng naturang petisyon sa Kataas-Taasang Hukuman ay paglabag aniya sa doctrine of hierarchy of courts at sinabing dapat inihain sa mababang korte ang petisyon.
“The Court held that petitions were dismissible for violating the doctrine of hierarchy of courts as the resolution of the issues raised therein required the determination and adjudication of extremely technical and scientific facts that necessitates the conduct of a full-blown proceeding before a court of first instance,” dagdag ng Korte Suprema.
