INIHAIN ng petitioner na si Atty. Moises Tolentino ang motion for reconsideration (MR) kasunod ng pagbasura ng Commission on Elections (COMELEC) 2nd division sa disqualification case ni Erwin Tulfo.
Para kay Atty. Moises Tolentino, dapat baguhin ng COMELEC 2nd division ang desisyon nito sa disqualification case laban kay Erwin Tulfo bilang nominee ng ACT CIS noong 2022 elections.
Nagsumite ito ng motion for reconsideration para ikontesta ang naging ruling ng second division
Matatandaan na binasura ng COMELEC 2nd division ang kaso dahil sa kakulangan umano ng hurisdiksiyon dahil nai-file ang petition 9 na buwan pagkatapos ang proklamasyon.
Batay sa COMELEC rules, dapat ang petisyon ay naisumite bago pa ang proklamasyon.
Ayon sa petitioner, ang pagdedeklara ng COMELEC na wala itong hurisdiksiyon ay labag umano sa batas at jurisprudence.
“It would be a grave abuse of discretion for the Honorable Commission to abdicate its constitutionally-mandated duty to enforce the law on a dubious excuse that it lacks the jurisdiction and competence so to do taking into consideration the totality of the circumstances obtaining in this case,” pahayag ni Atty. Moises Tolentino, Petitioner.
Matatandaan na inihain ni Tolentino ang disqualification case dahil sa issue ng citizenship ni Tulfo at ang conviction nito para sa libel case.
Saad ng petitioner na hindi pa naibalik ni Tulfo ang kaniyang citizenship at nanatiling issue ang moral turpitude sa krimeng nagawa nito.
“Tulfo has not regained his status as a Filipino citizen, and stresses payment of fines in lieu of service of prison terms, does not in any way remove the character of the offense for which the respondent was convicted, libel being a crime involving moral turpitude,” dagdag ni Tolentino.
Ang mga nakasulat aniya sa petition ay suportado ng ebidensiya.
Samantala, kasunod ng MR, iaakyat ang petisyon sa COMELEC en banc para doon resolbahin ang kaso.
