‘Diffusion notice’ misused to arrest Duterte and transport him to The Hague

IN a newspaper piece, former Senator Francisco Tatad explained the difference between a “Red” and “Diffusion” notice from the INTERPOL, and why both are not warrants to arrest an individual.

This means that former President Rodrigo Roa Duterte was transported to The Hague by misusing a Diffusion notice.

“According to the existing literature, a Red notice is the highest alert issued by INTERPOL at the request of a member country or an international organization. It serves as a global request for law enforcement agencies to locate and ‘provisionally arrest’ a wanted individual pending extradition or legal action. However, it is not an arrest warrant in itself,” he said.

“The notice requires approval from the INTERPOL’s General Secretariat and can only be issued when it meets strict legal standards. A ‘Diffusion notice,’ on the other hand, requires no such approval, and serves as a mere tool for information-sharing without any obligation on the part of any party to act.

The “Diffusion notice” on Duterte was therefore misused to arrest and transport him without due process to The Hague,” Tatad added.
