SA pagpapatuloy ng pagdinig ng Senado araw ng Lunes sa Resolution of Both Houses Number 6 ay sinabi ni Retired Supreme Court Associate Justice Antonio Carpio na kahit hindi amyendahan ang Konstitusyon ay marami namang naipasang batas na nagbubukas sa ekonomiya sa 100% foreign ownership.
“There appears to be a lack of understanding by national leaders of the extent of foreign ownership under the law of businesses in the country,” ayon kay Antonio Carpio, Senior Associate Justice (Ret), Supreme Court.
Kamakailan kasi ay sinabi ni Pangulong Ferdinand R. Marcos Jr., na bukas siya sa suhestiyon na amyendahan ang economic provisions ng Saligang Batas puwera na lang ang mga nasa kritikal na sektor.
“In an interview, President [Ferdinand] Marcos Jr. declared that he wants to open the economy to foreign investments and I quote, ‘except in critical areas such as power generation. Power generation from coal, oil and gas plants has always been open to 100 percent foreign ownership for the longest time,” ayon kay Antonio Carpio, Senior Associate Justice (Ret), Supreme Court.
Dagdag ni Carpio, mayroon na ring 100% foreign ownership sa power generation tulad ng Dams at Hydropower plants.
Maging sa renewable resources tulad ng solar at wind energy ay pinayagan na rin ang 100% foreign ownership. Sa katunayan ani Carpio ito ay naipatupad sa bisa lamang ng isang implementing guideline o isang circular mula sa Department of Energy (DOE) at Department of Justice (DOJ).
Sa ilalim naman ng naamyendahang Public Services Act (PSA) ay pwede na rin sa Pilipinas ang 100% foreign ownership sa telecommunications, at maging sa air, sea, land transport maliban na lamang sa public utility vehicles at airports.
Ang mga local banks ay bukas na rin sa 100% foreign ownership sa bisa ng RA 1064.
Kaugnay rito ay binatikos din ni Carpio ang mga ponente o nagsusulong ng People’s Initiative (PI) na aniya’y sinisisi ang mahigpit na economic provisions sa situwasyon ng ekonomiya ng bansa.
Ang sisihin aniya ang mababang foreign investment, mataas na unemployment, at mabagal na economic growth ay maling akusasyon.
“We have to address the real causes. The real cause is not the Constitution. Nobody cares. The President has been going abroad and has been saying, ‘I have secured almost P500-B in foreign investment’ and not one of those foreigners who plan to invest here required an amendment to our Constitution,” ani Carpio.
Pagdinig ng Senado sa pag-amyenda ng ilang economic provisions ng Konstitusyon, nagpapatuloy
Sa kabilang banda ay kinilala naman ng political scientist na si Professor Clarita Carlos ang mga batas na nagbubukas ng 100% foreign ownership sa bansa pero ang tanong aniya ay sapat ba ang mga nasabing batas para sa mga foreign investor?
“So however, much we believe in these things, as a social scientist, if they are not empirically grounded, laway lang po yan,” ani Prof. Clarita Carlos, Social Scientist.
Pero ayon naman sa European Chamber of Commerce in the Philippines (ECCP), malaki ang naitulong sa kanilang pagnenegosyo ang naamyendahang PSA.
“It was a very positive feeling, after 80 plus years the law has finally been amended. And as I mentioned earlier, it has really contributed to the attractiveness of the Philippines among the foreign investors,” ayon naman kay Florian Gottein, Executive Director, European Chamber of Commerce in the Philippines.
Sa katunayan dagdag pa ni Gottein na higit sa 100 foreign investors ang nadagdag mula sa Europe dito sa Pilipinas matapos na ma-amyendahan ang PSA.
Sa kabila naman ng paglabas ng magkakaibang pananaw ng mga resource persons kaugnay sa pag-amyenda sa ilang economic provisions ng Saligang Batas ay ikinatuwa naman ito ni Sen. Sonny Angara, ang Chairperson ng Subcommittee on Constitutional amendments and Revision of Codes na nangunguna sa pagdinig.
Ayon sa senador, ito ang kauna-unahang pagkakataon na hindi political provisions ang tinatalakay sa Senado kaugnay sa pagsusulong ng Cha-Cha.
“I think, it’s good that we go through the exercise, first time ito nangyari na napag-usapan nang detalyado eh. Lagi kasing usapin ‘yung nagsesentro sa politikal na kondisyon. ‘Yung dapat bang magkaroon ng Parliamentary System. Nung last time na nag-hearing sina Senator Pangilinan, Chairman ng dating Committee on Amendments, ang napag-usapan noon is Federalism pa. Ngayon ibang-iba na,” ayon naman kay Sen. Sonny Angara, Chair, Sub-Committee.
